JAMIE FOXX FACES LAWSUIT FOR ALLEGED ROOFTOP SEXUAL ASSAULT

Jamie Foxx is being sued by a woman who claims he sexually assaulted her at a New York rooftop bar in 2015.

According to legal documents obtained by TMZ, the alleged victim claims in her suit that Foxx groped her after she asked him for a photo

The actor, singer and comedian is accused of “sexual assault, abuse, assault and battery” and is being sued for damages.

Foxx has not yet responded to the lawsuit or claims within.

According to the lawsuit, the alleged assault took place around 1 a.m. in August 2015 at Catch NYC.

The lawsuit claims that Jamie Foxx appeared intoxicated and agreed to a photo with the woman, allegedly telling her: “Sure, baby, anything for you.”

The Day Shift star is alleged to have led the woman to a more secluded part of the restaurant before touching her breasts and putting her hands in her underwear without her consent. The lawsuit claims the incident stopped when the woman’s friend came looking for her.

The lawsuit is also seeking damages from Catch NYC and its owner Mark Birnbaum, who the woman claims breached their duty of care. Birnbaum has also not yet commented on the lawsuit.

As a result of the alleged offence, the woman claims she “suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder and other physical and emotional damages.”

The legal action comes days before the New York Adult Survivors Act— which allows alleged victims of sex crimes to sue after the statute of limitations has lapsed — ends on 24 November.

A number of other high profile stars have also recently had lawsuits filed against them under the act, including Diddy, Jimmy Iovine, L.A. Reid, Cuba Gooding Jr., Bill Cosby, Axl Rose and Russell Brand.

Jamie Foxx has been accused of sexual harassment in the past. In 2018, the Oscar-winner was accused of slapping a woman with his penis while in Las Vegas in 2002.

A spokesperson for the actor denied the allegation, saying: “Jamie Foxx emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him.

“The first time Mr. Foxx became aware of this woman’s absurd claims about an incident that supposedly occurred sixteen years ago was when TMZ contacted his representatives today about this story.”

Foxx was never charged or sued regarding the alleged 2002 incident.
