In a bold legal move, Los Angeles rapper G Perico has filed a federal lawsuit against luxury fashion brand Coach and its parent company, Tapestry, claiming they unlawfully copied his trademarked slogan and profited from it without his permission. The lawsuit centers around G Perico’s distinctive phrase, “this is a blue t-shirt,” which has become integral to his brand identity and overall business model.
The artist, whose real name is Jeremy Nash, registered the trademark in 2022 for various clothing items, including shirts, hats, and outerwear. He has been actively promoting this brand through his music, videos, concerts, and online presence, creating a strong consumer association with his name and the slogan.
According to the lawsuit, Coach began selling shirts emblazoned with “this is a Coach t-shirt,” which G Perico argues creates confusion among consumers and damages his brand. He contends that the luxury brand never sought permission to use his trademark, nor did they offer any compensation for its use.
G Perico’s attorney, Andrew Williams, stated, “By using the Infringing Mark, [Coach] attempted to create a connection and benefit from the success and popularity of [G. Perico] and the Trademark, which in turn has generated, on information and belief, hundreds of thousands, if not millions of dollars for [Coach].”
The lawsuit seeks damages exceeding $150,000, along with all profits generated from the alleged infringement, legal fees, and a jury trial. G Perico is also requesting an accounting of revenue tied to the Coach products and an injunction to prevent further use of the slogan.
At the heart of this case lies the question of whether Coach’s wording is sufficiently similar to G Perico’s trademark to constitute a violation of federal law. The complaint outlines the extensive retail reach of Coach, suggesting that the company’s actions have significantly undermined the value of G Perico’s trademark.
As of now, Coach and Tapestry have not publicly responded to the allegations in court. This lawsuit highlights the ongoing tensions between artists and major brands over intellectual property rights, particularly in the ever-evolving landscape of music and fashion.
