Davis’ defense team, led by criminal attorneys Robert Draskovich and William Brown, filed a motion asserting that a judge was misled into believing that Davis posed a danger as a drug dealer, which they argue was a critical factor in granting a nighttime search warrant. The defense paints a different picture of Davis, describing him as a retired gang leader who left the drug trade behind in 2008. By the time of the search, he was a 60-year-old cancer survivor living a quiet life in Henderson, Nevada, with his wife and family. His attorneys argue that the court was not provided with accurate information about his current situation, leading to an unjust execution of the search warrant.
The Las Vegas Metropolitan Police Department, which carried out the search resulting in the confiscation of Davis’ electronic devices and other items, has refrained from commenting on the ongoing litigation. They previously stated that executing the warrant at night was a tactical decision to ensure the safety of surrounding residents and to secure the premises effectively.
Davis was arrested in September 2023 and has pleaded not guilty to first-degree murder.
