
Rod Wave is currently embroiled in a legal dispute concerning the cover art of his 2024 album, Last Lap. A photographer from Florida has initiated a lawsuit against the rapper, alleging that his image was utilized without proper authorization. The complaint asserts that Rod Wave and his team have reaped significant financial benefits from this infringement, with the photograph appearing on album covers, merchandise, and promotional materials for his upcoming tour.
According to a report by Billboard, the complaint, filed on December 11, indicates that Tampa-based photographer Allan Salas captured the contentious image during a concert in August 2024, where Rod Wave performed in his hometown. The photograph depicts the artist passionately gripping a microphone mid-performance, which subsequently became the official album cover for Last Lap. Salas contends that he was never compensated for the use of his image and that Rod’s team disregarded repeated notifications regarding his ownership of the rights to the photograph.
The lawsuit details how, despite the album’s release featuring the unauthorized image, Rod Wave’s team continued to exploit the photograph across various platforms, including promotional materials for a 28-date arena tour. Additionally, Salas claims that the image was used on merchandise such as T-shirts, amplifying the unauthorized use of his work.
His legal representatives have emphasized in the lawsuit that the defendants not only released the album with the unauthorized photograph but also expanded its use, stating, “Even though the defendants had already commercially released the album, which contained unauthorized uses of the photograph, the defendants doubled down and tripled down on their unauthorized use.”
Last Lap achieved significant commercial success, debuting at No. 2 on the Billboard 200 and maintaining a presence on the chart for an impressive 56 weeks. Salas argues that the album’s success exacerbated the damages incurred due to the unauthorized use of his image. He asserts that while he was granted access to photograph the Tampa concert, he retained ownership of all images taken that night, a fact that Rod’s team was allegedly made aware of prior to their continued use of the photograph without securing a license or offering compensation.
This lawsuit is not Rod Wave’s first run-in with the law this year. Earlier, he faced a staggering $27 million lawsuit from Grizzly Touring LLC, his former concert promoter, who accused him of breaching contract terms and failing to return an advance payment. The outcomes of these ongoing legal challenges remain to be seen.
